These Website Terms of Use and Product Terms (“Terms”) govern your access to and use of our website, landing pages, content, digital products, audits, reports, templates, AI prompts, resources, email communications, and related services.
By accessing the website, purchasing a product, submitting a form, downloading materials, or using our services, you agree to these Terms and our Privacy Policy.
If you do not agree, do not use the website or purchase our products.
1. Business-to-Business Use
Our website and products are intended for business and commercial use by ecommerce store owners, founders, marketers, agencies, freelancers, and related professionals.
By purchasing or using our products, you represent that you are doing so for business or commercial purposes and not as a consumer for personal, household, or non-business use.
If you intend to use our products for personal purposes, you must contact us before purchase.
2. Eligibility
You must be at least 18 years old and legally able to enter into binding agreements to use this website or purchase our products.
By using the website or purchasing a product, you represent that you meet this requirement.
3. Products Covered by These Terms
These Terms apply to all current and future digital products and services offered through this website, including but not limited to:
SectionLift Library
A low-ticket digital product that may include ecommerce page fixes, section patterns, prompts, visual examples, templates, AI assistant access, guides, or related resources.
Store Autopsy
A paid visual ecommerce store breakdown that may include annotated screenshots, buyer journey diagnosis, conversion issue identification, priority recommendations, first-screen review, product page review, mobile UX review, fix direction, and related deliverables.
Additional Services
We may also offer implementation, consulting, Shopify redesign, migration, CRO services, or other done-for-you services. Unless otherwise stated in a separate written agreement, these Terms apply to those services as well.
If a separate signed agreement, statement of work, invoice, product addendum, or written service agreement applies, that document controls for the specific service if there is a conflict.
4. No Guaranteed Business Results
Our content, products, audits, recommendations, templates, examples, prompts, and strategies are provided for informational, educational, diagnostic, and business improvement purposes.
We do not guarantee any specific conversion rate, revenue increase, sales result, profit, customer acquisition cost reduction, return on ad spend, traffic level, ranking, or business outcome.
Results depend on many factors outside our control, including your product, offer, pricing, market, traffic quality, advertising strategy, brand trust, product demand, implementation quality, website platform, technical setup, inventory, seasonality, competition, and customer behavior.
Any examples, testimonials, case studies, or numbers shown are individual results and are not a promise or guarantee that you will achieve similar results.
5. Store Autopsy Scope
Store Autopsy is a visual and strategic ecommerce review based on the information available to us at the time of review.
Unless expressly stated otherwise, Store Autopsy does not include:
- full website redesign;
- implementation of recommendations;
- custom development;
- SEO migration;
- analytics setup;
- paid ad management;
- A/B testing;
- legal review;
- tax advice;
- accounting advice;
- guaranteed conversion uplift;
- guaranteed revenue growth;
- ongoing support after delivery;
- unlimited revisions.
Store Autopsy recommendations are professional opinions based on ecommerce, UX, CRO, design, and buyer journey principles. You are responsible for deciding whether and how to implement them.
6. SectionLift Library Scope
SectionLift Library is a digital resource library.
It may include examples, prompts, page patterns, design references, section ideas, and educational materials. It is not a personalized audit unless specifically stated.
SectionLift Library may help you identify and implement improvements, but it does not guarantee any particular business result.
Access may be provided through download links, email, a members area, a document, a platform, a file, an AI assistant, or another delivery method we choose.
7. AI Tools, Prompts, and Outputs
Some products may include AI prompts, AI assistant access, or AI-assisted resources.
AI outputs may be inaccurate, incomplete, outdated, or unsuitable for your specific business. You are responsible for reviewing, editing, testing, and legally clearing any AI-generated content before using it publicly.
Do not submit sensitive, confidential, regulated, or third-party information into any AI tool unless you are authorized to do so and accept the associated risk.
We are not responsible for losses, claims, or damages caused by your use of AI-generated outputs.
8. Client Cooperation
For Store Autopsy or any personalized service, you agree to provide accurate and timely information, including your store URL, ecommerce platform, product/category, current concerns, and any optional analytics or screenshots you choose to provide.
Our ability to provide useful recommendations depends on the quality and completeness of the information you submit.
If you fail to provide required information, delay responses, submit inaccurate information, or prevent us from accessing necessary pages, delivery timelines may be extended and our obligations may be limited.
9. Delivery and Acceptance
Delivery timelines may be stated on the checkout page, product page, email, invoice, or onboarding form.
Delivery timelines begin only after we receive all required information from you.
For personalized deliverables, you have 72 hours after delivery to notify us in writing of any access issue, missing file, technical delivery issue, or material non-conformity with the purchased scope.
If you do not notify us within 72 hours, the deliverable will be deemed accepted.
This does not remove any refund rights expressly provided under a specific written guarantee, but it helps us resolve delivery issues quickly.
10. Pricing, Payments, Taxes, and Currency
All prices are listed in the currency shown at checkout, usually USD unless otherwise stated.
You agree to pay all fees shown at checkout or on the invoice.
You are responsible for any applicable taxes, VAT, sales tax, duties, bank fees, currency conversion fees, foreign transaction fees, and payment processor charges.
Payment processors may have their own terms and privacy policies.
We may change prices, offers, bonuses, discounts, or product availability at any time. Changes do not affect completed purchases unless expressly stated.
11. Refund Policy
Except where a specific written guarantee applies, all digital product and service purchases are final and non-refundable to the fullest extent permitted by law.
Because SectionLift Library and similar products may provide immediate access to digital materials, refunds are not guaranteed unless expressly offered.
Because Store Autopsy involves time, expertise, analysis, and custom work, refunds are not available once work has begun, except under the specific written guarantee below or as required by law.
12. Store Autopsy Results-Driven Guarantee
Where offered on the product page at the time of purchase, Store Autopsy may include the following limited guarantee. The detailed eligibility rules are set out in the Refund & Results Guarantee Addendum:
If you implement at least three priority recommendations from your Store Autopsy and do not see any measurable improvement within 14 days after implementation, you may request a refund.
A measurable improvement may include improvement in conversion rate, add-to-cart rate, checkout reached rate, revenue per visitor, average order value, bounce/exit behavior on a key page, or another relevant ecommerce metric agreed in writing.
To qualify for this guarantee:
- You must implement at least three priority recommendations from the Store Autopsy.
- The recommendations must be implemented correctly and kept live for at least 14 consecutive days.
- Your store must receive enough relevant traffic during the test period to reasonably measure performance.
- You must provide before/after evidence, including screenshots of implemented changes and analytics or store data showing the relevant metrics.
- You must submit your refund request to support@thankik.com within 14 days after the test period ends.
- You must not materially change your product offer, pricing, traffic source, ad strategy, checkout, platform, major apps, inventory, or store structure during the test period unless disclosed and approved in writing.
This guarantee applies only to the Store Autopsy purchase price and is your sole remedy for dissatisfaction with Store Autopsy.
We reserve the right to deny refund requests that are incomplete, unsupported, fraudulent, abusive, based on incorrect implementation, based on insufficient traffic, or based on changes outside our recommendations.
13. SectionLift Library Practical Value Guarantee
Where offered on the product page at the time of purchase, SectionLift Library may include a limited 14-day practical value guarantee.
If SectionLift Library does not give you at least three practical ideas you can apply to your ecommerce store, email support@thankik.com within 14 days of purchase and explain what you reviewed and why it was not useful.
This guarantee is limited to the purchase price of SectionLift Library and does not apply to customers who downloaded, copied, redistributed, resold, shared, or misused the materials.
14. Chargebacks and Payment Disputes
Before initiating any chargeback, payment dispute, reversal, or claim with your bank, card issuer, or payment processor, you agree to first contact us at support@thankik.com and allow us a reasonable opportunity to resolve the issue.
Improper chargebacks may result in suspension of access, cancellation of deliverables, collection of unpaid amounts, and submission of evidence to the payment processor.
Nothing in this section limits any non-waivable rights you may have under applicable law.
15. Intellectual Property
All website content, product materials, templates, prompts, frameworks, reports, audit structures, screenshots with annotations, methodologies, design examples, copy examples, videos, graphics, and other materials provided by us are owned by us or our licensors.
You receive a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use purchased materials for your own internal business purposes.
You may not:
- resell our products;
- share access with third parties;
- upload materials to public platforms;
- distribute files to clients unless an agency license is purchased;
- copy our product structure to create a competing product;
- remove copyright notices;
- sublicense, rent, lease, or transfer materials;
- use our materials to train AI models or build competing AI tools;
- publish our paid materials publicly.
Unauthorized use may result in termination of access and legal action.
16. Agency, Freelancer, and Client Use
Unless you purchase a separate agency or extended license, SectionLift Library and Store Autopsy materials are for use inside your own business only.
If you are an agency, freelancer, consultant, or service provider and want to use the materials with your clients, you must request written permission or purchase an appropriate license.
You may not resell SectionLift Library, Store Autopsy format, prompts, templates, or reports as your own standalone product.
17. User Content and Store Materials
You retain ownership of the original materials you submit, including store screenshots, analytics exports, brand assets, website links, and business information.
You grant us a limited license to access, review, copy, annotate, analyze, and use those materials solely to provide the purchased product or service, communicate with you, maintain internal records, protect our rights, and improve our process.
You represent that you have the right to submit all materials you provide.
18. Testimonials, Reviews, and Case Studies
If you submit a testimonial, review, feedback, success metric, or case study information, you confirm that it is truthful and based on your actual experience.
You grant us permission to use testimonials, feedback, your name, business name, public website URL, public store screenshots, and success metrics for marketing purposes, unless you notify us in writing that you do not want to be featured.
We may edit testimonials for length, clarity, grammar, formatting, or presentation, but we will not knowingly change the meaning.
You may request removal of a testimonial by contacting support@thankik.com. We will make reasonable efforts to remove it from future marketing, though previously published materials may not be immediately removable from all channels.
We do not allow fake testimonials or fabricated results.
19. Third-Party Services
Our website and products may rely on third-party platforms, including checkout providers, hosting services, email platforms, analytics tools, advertising platforms, AI providers, website builders, cloud storage tools, and ecommerce platforms.
We are not responsible for third-party services, outages, fees, data practices, policy changes, account suspensions, or technical issues.
Your use of third-party platforms is governed by their own terms and privacy policies.
20. Acceptable Use
You agree not to:
- use the website or products for unlawful purposes;
- attempt to hack, disrupt, scrape, overload, or reverse engineer our website or systems;
- share, leak, resell, or publicly distribute paid materials;
- submit false, misleading, infringing, harmful, or unauthorized content;
- use our materials to create a confusingly similar or competing product;
- abuse refund policies, chargebacks, or guarantees;
- impersonate another person or business;
- violate any law, platform rule, or third-party right.
We may suspend or terminate access for violations.
21. Disclaimers
The website, products, materials, audits, reports, recommendations, AI outputs, and related services are provided “as is” and “as available.”
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, availability, and uninterrupted operation.
We do not guarantee that recommendations will be error-free, complete, suitable for every business, or profitable.
You are responsible for reviewing, testing, implementing, and validating any recommendation before relying on it.
22. Limitation of Liability
To the fullest extent permitted by law, Thankik and related representatives will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including lost profits, lost revenue, lost data, lost traffic, lost rankings, lost business opportunity, ad spend losses, platform suspension, reputational harm, or business interruption.
To the fullest extent permitted by law, our total liability for any claim arising from or related to the website, products, or services will not exceed the amount you paid for the specific product or service giving rise to the claim.
23. Indemnification
You agree to defend, indemnify, and hold harmless Thankik, contractors, service providers, and representatives from claims, damages, liabilities, losses, costs, and expenses arising from:
- your use of the website or products;
- your implementation of recommendations;
- your business, products, advertising, website, or customer claims;
- your violation of these Terms;
- your violation of any law or third-party right;
- your submitted materials;
- your misuse of our intellectual property.
24. Changes to Products and Terms
We may update products, bonuses, prices, materials, access methods, and these Terms at any time.
If we make material changes, we may update the “Last Updated” date.
Your continued use of the website or products after changes means you accept the updated Terms.
25. Termination
We may suspend or terminate access to the website, products, downloads, AI tools, or services if you violate these Terms, fail to pay, initiate an abusive chargeback, misuse materials, or create legal, technical, or reputational risk.
Termination does not waive any rights or payment obligations that accrued before termination.
Sections related to payments, refunds, intellectual property, disclaimers, limitation of liability, testimonials, confidentiality, indemnification, and dispute resolution survive termination.
26. Governing Law and Dispute Resolution
These Terms are governed by the laws of Ukraine, unless another governing law is required by applicable non-waivable law.
Before filing any claim, the parties agree to first attempt to resolve the dispute informally by emailing support@thankik.com.
If a dispute cannot be resolved informally within 30 days, it will be resolved by the competent courts of Ukraine, unless a different forum is required by applicable non-waivable law or agreed in writing.
27. Severability
If any part of these Terms is found invalid or unenforceable, that part will be modified to the minimum extent necessary to make it enforceable, or removed if modification is not possible. The remaining Terms will continue in effect.
28. No Waiver
Failure to enforce any part of these Terms does not waive our right to enforce it later.
29. Entire Agreement
These Terms, together with the Privacy Policy, product page terms, checkout terms, invoices, and any written product-specific agreement, form the entire agreement between you and us regarding the website and products.
You acknowledge that you are not relying on any promise, guarantee, or representation not expressly stated in these Terms or a written agreement.
